An Internet gambling operator based in Panama is facing a lawsuit by a Las Vegas casino company for the second one time. The net casino operator has already previously lost trademark infringement charges to MGM Mirage, and now's accused of using Station Casinos brands for its Internet domain names.
Smart Answer lost the same suit last year for using MGM Mirage names like Bellagio, Circus Circus, and Mandalay Bay to lure patrons to its Internet casinos. MGM won an injunction against the Panamanian outfit, and was granted $2.2 million in damages.
MGM took over the disputed domain names, but was unable to assemble damages.
Stations says Smart Answer has now arrange websites using trademarks including Palace Station, Boulder Station, and Sunset Station. Stations Casinos says the sites all link to online gambling site Golden Casino.
"Defendants' actions have disrupted or are intended to disrupt plaintiff's business by, among other things, diverting web users clear of plaintiffs' Internet sites and to the net gambling Web page defendants associated with the infringing domain names," the lawsuit stated.
Station officials hope to get an injunction barring further use in their brands. Damages also are sought, though the MGM case indicates there is difficulty in any actual collecting of monies awarded.
